Which is the basis of my entire opinion. They knew the risks, they were adults, they signed a waiver.
However.....
Given the litigious "blame game" society we live in I'm sure lawyers will get involved and money will exchange hands either out of court or otherwise because (as we're seeing here in this thread) the general attitude of the populous is that no one is responsible for their own actions.
