The fact that Rush has died -- if he has -- does not absolve his company of responsibility. The fact that they were all adults does not either. The fact that people die every day does not.
I have no pitchfork. I'm not wound up.
But I think, in the end, the waiver will prove decisive.
However, if negligence or misrepresentation or falsehoods were in play here, even that may not be sufficient.
I'm not looking to make anyone 'pay'. But those responsible should be held accountable for what happened here. The fact Rush is probably dead does not remove that responsibility from the corporation he owned.
I don't think we've begun to see the cascade of bad decisions that led to this fate. Whether a waiver assuming the risk is enough to counter that, I wouldn't know.
