Agreed. If anyone looked at that sub, and its controls, and still got in it, that's on them. The only possible mitigating factor is if they were lied to or misled about the testing or certification of the sub or something, but still, looking at the setup does not instill confidence.

I can't agree with F4UDash's position here.

The fact that Rush has died -- if he has -- does not absolve his company of responsibility. The fact that they were all adults does not either. The fact that people die every day does not.

I have no pitchfork. I'm not wound up.

But I think, in the end, the waiver will prove decisive.

However, if negligence or misrepresentation or falsehoods were in play here, even that may not be sufficient.

I'm not looking to make anyone 'pay'. But those responsible should be held accountable for what happened here. The fact Rush is probably dead does not remove that responsibility from the corporation he owned.

I don't think we've begun to see the cascade of bad decisions that led to this fate. Whether a waiver assuming the risk is enough to counter that, I wouldn't know.

Which is the basis of my entire opinion. They knew the risks, they were adults, they signed a waiver.


However.....


Given the litigious "blame game" society we live in I'm sure lawyers will get involved and money will exchange hands either out of court or otherwise because (as we're seeing here in this thread) the general attitude of the populous is that no one is responsible for their own actions.

But legally the son at 19 (I believe) was an adult. Old enough in the US to vote and to go to war. My oldest was a Marine before he turned 19

I am not a "lawsuit hungry" type of person, but in this case it sure seems that not only was there a blatantly obvious shortcoming in hardware specification for the intended usage, but also a "cover up" when said shortcoming was brought to the attention of those in charge.

And people are now dead because of that. I'd bet my entire net worth that nowhere in those waivers did it say "We're taking you to a depth 3x what the window is designed for".

If that's not justification for a lawsuit I don't know what is...

I feel way less comfortable now with Boeing's use of carbon fiber on their airplane hulls now.

The forces involved in an aircraft rising from sea level to 30,000+ feet vs a sub descending to 10,000+ deep are vastly different by multiple orders of magnitude.

One would think if the safety issues with this thing were so blatantly obvious (other than to unsuspecting rich tourists) that an expert like Paul-Henri Nargeolet would not have been onboard.

Modern materials shouldn't be underestimated.

I had a pair of inline skates back in 1992 and at some point I wanted to enlarge one of the axle holes on the frames (and for the life of me I can't remember WHY now...).

PLASTIC frames.

I put one frame into a drill press, and attempted to enlarge a hole by about 1mm.

I ended up hanging my entire 150lb body weight on the drill press crank.

There was absolutely ZERO effect on that plastic hole.

I was blown away. No ordinary metal would have survived like that. I think even if that frame had been made of titanium I would have left more of a mark at the very least...
